TERMS OF USE

Welcome to Healthye. These Terms of Use ("Terms") govern your access to and use of the Healthye mobile application ("Application") provided by Healthye Vibe LLC ("Company", "we", "us", or "our"). By using the Application, you agree to be bound by these Terms. If you do not agree, please do not use the Application.

1. LICENSE TO USE

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Application for non-commercial, personal wellness and health-tracking purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the Application or its content;
• Reverse engineer, decompile, or attempt to extract the source code;
• Use the Application for illegal or unauthorized purposes;
• Attempt to access data or features not explicitly provided to you;
• Use the Application for commercial purposes, including but not limited to resale, data aggregation, or integration into third-party services without explicit permission.

2. FUNCTIONALITY AND HARDWARE USAGE

2.1. Camera and Flashlight

The Application uses your device's camera and flashlight to measure pulse via photoplethysmography (PPG). No images or video are recorded, saved, or transmitted.

2.2. Bluetooth Device Integration

You may optionally connect third-party Bluetooth heart rate monitors (e.g., Polar, Garmin). Data from these devices is used locally and not transmitted externally.

2.3. Apple HealthKit Integration

If access is granted, HealthKit data is used solely within the Application and never transmitted or stored outside your device.

2.4. RR Interval Analysis via Cloud

For HRV/stress analysis, anonymized RR intervals may be temporarily sent to Firebase Cloud Function:

• No identifiers (including UUID) are included.
• Data is transmitted over encrypted connections (HTTPS/TLS).
• Each request is isolated—no linkage to users or devices is possible.
• Data is processed immediately and deleted—no server logs or caching.
• Results are returned to your device and stored locally.

2.5. Realm and Local Storage

All data is stored only locally. None of your measurements are transmitted without your explicit permission.

3. SUBSCRIPTION FEATURES

Subscription pricing and renewals are managed by Apple via the App Store. We do not collect or store payment information.

All subscriptions and in-app purchases are processed by Apple via the App Store. We do not handle payment data—transactions are subject to Apple's terms and privacy policy. Refunds must be requested through Apple's platform.

We use third-party services:

• Firebase – analytics, crash reporting, RR processing.
• Amplitude – anonymous usage metrics (e.g., feature engagement).

No behavioral profiling or cross-service tracking. See our Privacy Policy for details.

6. INTELLECTUAL PROPERTY

The Application, including its design, algorithms (including PPG technology), UI/UX, and content, is protected by copyright and other intellectual property laws. Unauthorized copying, reverse engineering, or distribution of the Application or its components is strictly prohibited.

All trademarks, design, and content are owned by the Company. No reuse is permitted without express written permission.

7. USER RESPONSIBILITIES

Do not:

• Rely solely on the Application for medical decisions.
• Use while driving or in unsafe conditions.

8. LIMITATION OF LIABILITY

You are solely responsible for ensuring your device meets the technical requirements for the Application. The Company is not liable for compatibility issues, data loss, or device malfunctions.

9. TERMINATION

We may suspend access if you violate these Terms.

We reserve the right to terminate access without notice for violations of these Terms, prolonged inactivity, or actions that may expose the Company to legal liability.

10. MODIFICATIONS

The Company may release updates requiring installation. Continued use of the Application constitutes acceptance of updated Terms.

Updated Terms will have a revised "Effective Date." Continued use = acceptance.
